the 9th amendment

the 9th amendment to the U.S. constitution states:

The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.

but wait… we’re still denying rights to people? i guess i’m confused by this. who decides which rights are not included in this statement?
